By using The SMS King, you agree to these Terms of Service. If you do not agree, please do not use the platform.

Use of the service

You may use The SMS King to send SMS messages to contacts who have consented to receive them. You are responsible for complying with all applicable laws, including anti-spam and data-protection regulations.

Account responsibilities

You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

Customer data responsibility

You are solely responsible for the contact data you upload, import, store, or use on this platform. This includes ensuring that:

• Every recipient has given valid, informed consent to receive marketing messages from you, in line with UK GDPR, PECR, and any other applicable law in the recipient's jurisdiction;
• Your contact data is accurate, up to date, lawfully obtained, and cleaned of numbers that should not be messaged (including opt-outs, ported landlines, and deceased or duplicate records);
• You honour opt-out requests promptly and maintain your own suppression lists;
• The content of the messages you send is lawful, truthful, and complies with the sending rules of your recipients' networks and regulators.

Neither Comms King, SMS King, nor RHOC Holdings Limited is responsible for verifying, validating, cleaning, or auditing customer data, nor for the lawful basis on which it was collected. Under UK GDPR you are the data controller of your contact data; we act only as a processor when transmitting messages on your instructions. You agree to indemnify Comms King, SMS King, and RHOC Holdings Limited against any claims, fines, or losses arising from your use of contact data on the platform.

Termination

We may suspend or terminate your access if you violate these terms or use the service in a manner that is unlawful or harmful.
